eClubUSA is a membership benefit and credit program that provides interest-free financing for computer systems, personal and home electronics, vacations and other services that are listed in our membership materials either in print or on our web sites.

 
  DESCRIPTION OF MEMBERSHIP  
  Membership and Merchant Credit Line are provided by eClubUSA, which is a d.b.a. of Players Vacation Club, Inc. a U.S. Corporation. eClubUSA provides a merchant credit line of up to $3,500 and is to be used solely for the products and services on the eClubUSA website. A member shall finance up to and no more than 85% of a computer, home electronic or vacation package and the actual amount is at the discretion of the finance department. A down payment from 15% to 35% is required before any product is shipped or vacation is booked. eClubUSA has the right to increase this amount based on membership and previous financing history. eClubUSA will then finance the remaining balance at a term between 12 and 18 months. Membership benefits are available to those individuals that meet or exceed the minimum requirements set forth by eClubUSA as well as have paid all membership dues in full. Membership shall remain valid on a recurring annual basis so long as membership dues are paid at their respective times each year or monthly depending on what membership payment plan you have, as well as having a good positive payment history on any finance item(s) including all items in the shopping cart, all computers and all financed vacation packages. Members requesting financing shall be made to verify through documentation the following : that they are 18 years or older, earn a minimum gross household income of $2,200, have a valid US checking account, have residence in the US and have worked at their current job for at least six months. The actual items of documentation required will be listed in the FAQ section of the website. Any member may also us a Guarantor (co-signer) in order to meet the income requirement. Any person(s) that provide false or misleading information during the sign up or order process will be subject to denial of financing and immediate cancellation of membership. eClubUSA has the right to deny financing to any member and for any reason that they deem reasonable.  
  BASIC MEMBERSHIP  
  Membership cost may vary depending on current promotions, sign up source, etc. All fees, however, will be clearly displayed on the join pages of each data form, affiliate join page or clearly stated by a live sales representative(if applicable). Membership fees will also be listed in the Terms and Conditions section of the above stated join forms. All members that use these forms will have access to full disclosures, terms and restrictions. All members that submit their information and authorize membership also agree to have their checking account or credit/debit card of record automatically debited for the new member dues as well as any renewal or monthly maintenance fees that is agreed upon at the time of sing up for as long as they are active members of eClubUSA. Current renewal pricing for eClubUSA is set at $89.00 annually. eClubUSA reserves the right to change these terms of the renewals at anytime and without notice. A renewal notification will be mailed to all active members at least 30 days prior to address listed in our database.  
  AMOUNT OF CREDIT  
  No credit shall be given prior to membership fees being paid in full and qualifications are verified. The amount of credit given to a member is the total remaining balance after receiving the required initial deposit. This amount at any given time may not exceed $3,500.00. In addition, first time users of this program may be limited to credit terms that shall not exceed a total of $1,400.00. This merchant line of credit is not intended to be used as a credit card and is only intended for the exclusive use on our members only websites. eClubUSA does not check credit in order for you to qualify for financing and there sets certain restrictions on its financing terms. The credit given to a member shall be for and only for that member and any reporting that is done to Transunion is also only for the member of record. Any member that establishes a perfect payment history on a current purchase agreement for at least six consecutive months may choose to proceed with a second purchase agreement at equal or less value. Members will be limited to a total of two open purchase agreements at any given time and is at the discretion of eClubUSA.  
  BASIC USAGE  
 

of the member financing is only available to the member listed on the account of record. You agree that you will use eClubUSA only on your own behalf and for the members of your immediate family who reside in your household. eClubUSA reserves the right to ask for additional deposits if your membership or payment history reflects any negative activity. Any fees or product payment returned to us NSF or un-paid for any reason may disqualify you from any future financing.

 
  PROBATIONARY CREDIT TERMS:  
 

eClubUSA reserves the right to place those members who have established a negative payment history by reducing the amount of credit available to $800 on any financed purchase and may increase the required deposit amount to 50%. Negative payment history includes (1) any returned NSF payments (2) any account of record closure, including but not limited to purchase agreement payments, monthly membership fees, and enrollment fees.

 
  CANCELLATIONS AND REFUNDS:  
 

Refund Policy: In order to cancel all members must call member services toll free at 877.532.2800 9am-5pm PST (west coast) or mail a handwritten request to the address listed under the contact us form of the website. Memberships can be cancelled within 30 days of the initial sign up date and receive a full refund of membership dues. If your account was processed via ACH, and paid, your refund will be issued by ACH directly into your account within 3 business days of cancellation. Cancellations that are done after 30 days are entitled to prorated refunds and are determined by how long the membership is active. Renewals will be refunded in full for up to ninety days from the date of payment(s).

Credit Cards: Members that join using Credit Cards / Debit Cards will be refunded back to the Credit Card / Debit Card within 3-5 business days from the cancellation date.

Check Drafts: In some instances we will process your member fees using check drafts rather than ACH when the checking routing and account number are provided. These drafts will appear on your bank account as a preauthorized check including our designated check number. In these instances the refund process will be 14-21 business days and issued to you via USPS in check form.

There are no cancellations permitted while currently financing a product or vacation with us. Once the purchase agreement is paid in full you may request a cancellation of the membership, but it will not be done automatically as most members choose to use our services multiple years.

 
  MEMBERSHIP TERMS  
  Your membership is effective for a period of twelve months following enrollment date under the annual membership plan. Each year you will be renewed as long as your monthly maintenance fees continue to be paid. Each year you will be notified by mail 30 days prior to the renewal date and any new membership materials will be shipped. This is known as a Continuity Plan. We reserve the right to increase or decrease the Renewal Fee for each new Membership Term.  
  FINANCE PAYMENTS  
  Financing is issued on select products and services to Members who agree to have their checking accounts or credit card debited for repayment of the credit extended on a monthly basis as listed in our membership materials. Payment terms range from 3 months to 18 months depending on the selected product or service and a separate promise to pay agreement between eClubUSA and the member will be sent for signature for each item financed by the member.  
  CREDIT BUREAU REPORTING  
  I understand that the company is a subscriber to a Credit Bureau(s) and that my new account as well as my monthly payment history will be reported to the Credit Bureau(s). The company reserves the right to not report your account to any credit bureau.

eClubUSA reserves the right to not report your account to any credit bureau for any reason should we elect. Member agrees that should there be a perceived discrepancy with any of the information reported to credit agency with regard to their account with eClubUSA member shall in writing submit to us a request to verify and or correct any information that may be inaccurate or incomplete.   DEFAULT ON ACCOUNT  
  I will be in default if: a) I fail to pay the " monthly payment" when due; or b) I breach any of the Terms and Conditions of the Purchase Agreement. If I am in default, then upon compliance with applicable law, eClubUSA has the right to: a) demand me to pay the entire unpaid balance on the account immediately; b) apply monies received on subsequent purchases to any delinquent account balance owed including late fees if applicable; and/or c) proceed with legal action.  
  DELINQUENT ACCOUNT  
  My account is considered delinquent if the Monthly Payment is not received by eClubUSA by the due date. If this occurs, a $15.00 late fee may be charged against my account and may reflect as a negative payment on my credit report with Transunion.  
  IDENTITY PROTECTION  
  All members financing any product or service may be required to provide to our finance department the following documentation for Identity, Residence and Employment verification purposes only: 1. Photocopy of valid state issued drivers license or identification card. 2. Photocopy of your federally issued social security card. 3. Photocopy of a current utility bill in your name and showing your current address. 4. Photocopy of a current pay stub in your name and showing a minimum of 6 months of employment.

Our underwriting department reserves the right to require the submittal of any additional forms of identification and or residential and employment documentation not stated here that it deems necessary to satisfy the above stated requirements for loan approval. If the documentation sent by you fails to satisfy these requirements to our satisfaction we reserve the right to refuse financing to anyone at anytime. The above requirements are meant to protect you the member and us against Identity theft and fraud.

Security Interest: eClubUSA, to the extent legally permissible, retains a security interest in all merchandise charged on your account until the balance is paid in full.
 
  SHIPPING:  
  All products are drop shipped from either our vendor or a third party company's affiliated with them using UPS or other major shipper. eClubUSA does not carry any stock of product and therefore does not guarantee any shipping time frame as many factors can determine this. Once an item is ordered by us from our vendor they generally will ship within 72 hrs unless the item is discontinued or back ordered. In these cases eClubUSA will contact you with alternative product choices that are equal or greater than the original item selected. eClubUSA is or it's vendors are not responsible for any damage that occurs during the shipping of an item. All damage claims are to be filed with the respective shipping company. All shipping addresses must be reflected on the signed purchase agreement for the item. eClubUSA will not process any order that specifies an address of a freight forwarder, warehouse, distribution center, airport, hotel, PO Box, APO Boxes, or any address other than the buyer listed on the purchase agreement.  
  AFFILATE OFFERS AND BENEFITS:  
  eClubUSA will at times offer affiliated services as added benefits exclusive to its members. These services are not managed or owned by eClubUSA and fulfilled by the affiliate themselves. All members are subject to the terms and conditions set forth by said affiliate. Any fees associated with these offers are for the sole benefit of the affiliate themselves and not eClubUSA. eClubUSA will not be responsible for any fees incurred due to payments associated with the affiliated offers.   STATE NOTICES  
   
  NOTICE FOR CALIFORNIA RESIDENTS:  
  California law requires that we inform customers that should they fail to fulfill the terms of their credit obligation, a negative report reflecting on their credit record may be submitted to a credit-reporting agency. If you are married, you may apply for credit in your own name.  
  NOTICE FOR FLORIDA RESIDENTS:  
  You (borrower) agree that, should we obtain a judgment against you, a portion of your disposable earnings may be attached or garnished (paid to us by your employer), as provided by Florida and Federal law.  
  NOTICE FOR OHIO RESIDENTS:  
  The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.  
  NOTICE FOR MARRIED WISCONSIN RESIDENTS:  
  No Agreement, unilateral statement or court decree relating to marital property adversely affects a creditor's interest, unless prior to the time credit is granted the creditor is furnished a copy of the Agreement, statement or decree, or has actual knowledge of the adverse position.  
  TRAVEL-RELATED RESPONSIBILITY AND LIABILITY:  
  eClubUSA (a dba acting through its parent company Player's Vacation Club, Inc.) shall have no liability in regard to any services provided by any vendor. You agree that any claim with regard to travel services shall be made against the vendor of such services and not eClubUSA; eClubUSA's sole obligation hereunder shall be to forward to the vendor all payments for services ordered and forward to you all the necessary travel documents. The hotels, carriers and other travel providers that supply services in connection with these vacations are independent contractors and are not agents of eClubUSA. All coupons, receipts, passes, and tickets issued by hotels, carriers and other suppliers are issued on the terms and conditions specified by the suppliers. eClubUSA does not have the authority to alter those terms. eClubUSA is not responsible for personal injuries, loss or damage of property, inconvenience or expense resulting from matters beyond its control, such as, acts of terrorism, defects in vehicles, breakdowns in equipment, government actions, strikes, theft, changes in itinerary or schedules, inclement weather and acts of God. eClubUSA may, in its sole judgment, make any changes and cancellations to vacation programs and schedules that it believes necessary. Individual programs and travel benefits within the eClubUSA membership program may be subject to separate terms and conditions and may be altered or substituted with products or services of equal or better value without prior notice to a member.
